Welcome to Hi-Line Pizza – The Best of Both Bites™! These Terms and Conditions (“Terms”) govern your use of the Hi-Line Pizza website (the “Site”), including any content, functionality, and services offered thereon, such as online ordering.

Please read these Terms carefully before you start to use the Site. By accessing or using the Site, you accept and agree to be bound and abide by these Terms. If you do not agree to these Terms, you must not access or use the Site.

Online Ordering & Account Registration

a. Eligibility: To place an order online, you must be at least the age of majority in your province of residence and have a valid payment method.

b. Account: You may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

c. Order Acceptance: All orders placed through the Site are offers to purchase our products. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities, inaccuracies in product information, or problems identified by our credit and fraud avoidance department.

d. Pricing & Availability: All prices are in Canadian dollars. We strive to provide accurate pricing and menu information; however, errors may occur. We reserve the right to correct any errors and to change prices and menu items at any time without notice. Product availability may vary by location.

Intellectual Property Rights

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by Hi-Line Pizza, its licensors, or other providers and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
The “Hi-Line Pizza” name, logos, and all related names, logos, product and service names, designs, and slogans are trademarks of Hi-Line Pizza or its affiliates or licensors. You must not use such marks without the prior written permission of Hi-Line Pizza.

User Conduct & Prohibited Uses

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

In any way that violates any applicable federal, provincial, local, or international law or regulation.
To engage in any fraudulent or deceptive activity.
To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
To impersonate or attempt to impersonate Hi-Line Pizza, a Hi-Line Pizza employee, another user, or any other person or entity.

Disclaimer of Warranties & Limitation of Liability

a. “As Is” Basis: Your use of the site and its content is at your own risk. The site is provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied.
b. Limitation of Liability: To the fullest extent provided by law, in no event will Hi-Line Pizza, its franchisees, affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the site, any websites linked to it, any content on the site, or any services obtained through the site, including any direct, indirect, special, incidental, consequential, or punitive damages.

Indemnification

You agree to defend, indemnify, and hold harmless Hi-Line Pizza, its franchisees, affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site.

Governing Law & Jurisdiction

These Terms and your use of the Site are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles. Any legal action or proceeding relating to your access to or use of the Site shall be instituted in the courts of the Province of Ontario.

Changes to the Terms

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
